These terms and conditions govern Paul Tours  Safari policy for Guest refunds (“Guest Refund Policy”) and the obligations of the Host associated with the Guest Refund Policy. The Guest Refund Policy applies in addition to Paul Tour Safari Terms of Service (“Paul Tours Terms”). The Guest Refund Policy is available to Guests who book and pay for an Accommodation through the Paul Tour Safari Platform and suffer a Travel Issue (as defined below).  The Guest’s rights under this Guest Refund Policy will supersede the Host’s cancellation policy.

All capitalized terms shall have the meaning set forth in the Paul Tours Safari Terms or Payments Terms unless otherwise defined in this Guest Refund Policy.

By using the Paul Tours Safari Platform as a Host or Guest, you are indicating that you have read and that you understand and agree to be bound by this Guest Refund Policy.

  1. Travel Issue

A “Travel Issue” means any one of the following:

(a) the Host of the Accommodation (i) cancels a booking shortly before the scheduled start of the booking, or (ii) fails to provide the Guest with the reasonable ability to access the Accommodation (e.g. does not provide the keys and/or a security code).

(b) the Listing’s description or depiction of the Accommodation is materially inaccurate with respect to:

  • the size of the Accommodation (e.g., number and size of the bedroom, bathroom and/or kitchen or other rooms),
  • whether the booking for the Accommodation is for an entire home, private room or shared room, and whether another party, including the Host, is staying at the Accommodation during the booking,
  • special amenities or features represented in the Listing are not provided or do not function, such as decks, pools, hot tubs, bathrooms (toilet/shower/bathtub), kitchen (sink/stove/refrigerator or major other appliances), and electrical, heating or air conditioning systems, or
  • the physical location of the Accommodation (proximity).

(c) at the start of the Guest’s booking, the Accommodation: (i) is not generally clean and sanitary (including unclean bedding and/or bathroom towels); (ii) contains safety or health hazards that would be reasonably expected to adversely affect the Guest’s stay at the Accommodation in Airbnb’s judgment, or (iii) has vermin or contains pets not disclosed in the Listing.

  1. The Guest Refund Policy

If you are a Guest and suffer a Travel Issue, you are covered by this policy as follows:

Up to 24 hours after check-in. If you report a Travel Issue up to 24 hours after check-in, we agree, at our discretion, to either (i) reimburse you the amount paid by you through the Paul Tours Safari Platform (“Total Fees”), or (ii) use our reasonable efforts to help you find and book for any unused nights left in your booking another Accommodation which is reasonably comparable to or better than the Accommodation described in your original booking in terms of size, rooms, features and quality. Paul Tour Safari shall decide whether an issue reported by a Guest qualifies as a Travel Issue, whether to reimburse or rebook a Guest who suffers a Travel Issue, and whether an alternate Accommodation is comparable or better.

More than 24 hours after check-in. If you report a Travel Issue more than 24 hours after check-in, we agree, at our discretion, to either (i) reimburse you up to the Total Fees depending on the nature of the Travel Issue suffered, or (ii) use our reasonable efforts to help you find and book another Accommodation for any unused nights left in your booking which is reasonably comparable to the Accommodation described in your original booking in terms of size, rooms, features and quality.

Paul Tour Safari  decisions under the Guest Refund Policy are final and binding on Guests and Hosts but do not affect other contractual or statutory rights you may have. Any right that you may have to initiate legal action remains unaffected.

  1. Conditions for making a Claim

To submit a valid claim for a Travel Issue and receive the benefits with respect to your booking, you are required to meet each of the following conditions:

(a) you must be the Guest that booked the Accommodation;

(b) you must report the Travel Issue to us in writing or via telephone within 24 hours of discovering the existence of the Travel Issue, and you must provide us with information (including photographs, videos, or other written or tangible evidence) about the Accommodation and the circumstances of the Travel Issue;

(c) you must respond to any requests by us for additional information or cooperation on the Travel Issue within the time specified by Paul Tour Safari;

(d) you must not have directly or indirectly caused the Travel Issue (through your action, omission or negligence);

(e) unless otherwise specified by Paul Tours Safari or Paul Tours Safari advises you that the Travel Issue cannot be remediated, you must use reasonable efforts to try to remedy the circumstances of the Travel Issue with the Host; and

(f) in order to receive a reimbursement of Total Fees or assistance with booking an alternative Accommodation, you must agree to vacate the Accommodation. If you choose to stay in the Accommodation, you may still qualify for a partial refund at Paul Tours Safari discretion as described in this policy (regardless of whether you reported the Travel Issue up to 24 hours after check-in).

  1. Minimum Quality Standards, Host Responsibilities and Reimbursement to Guest

4.1 If you are a Host, you are responsible for ensuring that the Accommodations you list on the Paul Tours Safari Platform are accessible, adequately and accurately described in the Listing description, safe and clean, and do not present a Guest with Travel Issues, as specified in these terms and in the Guest Refund Policy. During a Guest’s stay at an Accommodation, Hosts should be available, or make a third-party available, in order to try, in good faith, to resolve any Travel Issues or other Guest issues.

4.2 If you are a Host, and if (i) Paul Tours Safari determines that a Guest has suffered a Travel Issue related to an Accommodation listed by you and (ii) Paul Tours Safari either reimburses that Guest (up to their Total Fees) or provides an alternative Accommodation to the Guest, you agree to reimburse Paul Tour Safari  up to the amount paid by Paul Tours Safari within 30 days of Paul Tours Safari request. If the Guest is relocated to an alternative Accommodation, you also agree to reimburse Paul Tour Safari for reasonable additional costs incurred to relocate the Guest. You authorize Paul Tours Safari  Payments to collect any amounts owed to Paul Tour Safari  by reducing your Payout or as otherwise permitted pursuant to the Payments Terms.

4.3 As a Host, you understand that the rights of Guests under this Guest Refund Policy will supersede your selected cancellation policy. If you dispute the Travel Issue, you may notify us in writing or via telephone and provide us with information (including photographs or other evidence) disputing the claims regarding the Travel Issue. In order to dispute a Travel Issue, you must use reasonable and good faith efforts to try to remedy any Travel Issue with the Guest unless Paul Tour Safari  advises you that the Travel Issue cannot be remediated or the Guest has vacated the Accommodation.

  1. General Provisions

5.1 No Assignment/No Insurance. This Guest Refund Policy is not intended to constitute an offer to insure, does not constitute insurance or an insurance contract, does not take the place of insurance obtained or obtainable by the Guest, and the Guest has not paid any premium in respect of the Guest Refund Policy. The benefits provided under this Guest Refund Policy are not assignable or transferable by you.

5.2 Modification or Termination. Paul Tours Safari reserves the right to modify or terminate this Guest Refund Policy, at any time, in its sole discretion. If Paul Tours Safari modifies this Guest Refund Policy, we will post the modification on the Paul Tours Safari Platform or provide you with notice of the modification and Paul Tour Safari will continue to process all claims for Travel Issues made prior to the effective date of the modification according to the then applicable policy.

5.3 Entire Agreement. This Guest Refund Policy constitutes the entire and exclusive understanding and agreement between Paul Tours Safari and you regarding the Guest Refund Policy and supersedes and replaces any and all prior oral or written understandings or agreements between Paul Tours Safari and you regarding the Guest Refund Policy.

This includes but isn’t limited to facilitating the means to send spam and the initiation of network sniffing, pinging, packet spoofing, flooding, mail-bombing, and denial-of-service attacks.

Our Products must not be used to access any account or electronic resource where the group or individual attempting to gain access does not own or is not authorized to access the resource (e.g. “hacking”, “cracking”, “phreaking”, etc.).

Our Products must not be used for the purpose of intentionally or recklessly introducing viruses or malicious code into our Products and systems.

Our Products must not be used for purposely engaging in activities designed to harass another group or individual. Our definition of harassment includes but is not limited to denial-of-service attacks, hate-speech, advocacy of racial or ethnic intolerance, and any activity intended to threaten, abuse, infringe upon the rights of, or discriminate against any group or individual.

Other activities considered unethical, exploitative, and malicious include:

  1. Obtaining (or attempting to obtain) services from us with the intent to avoid payment;
  2. Using our facilities to obtain (or attempt to obtain) services from another provider with the intent to avoid payment;
  3. The unauthorized access, alteration, or destruction (or any attempt thereof) of any information about our customers or end-users, by any means or device;
  4. Using our facilities to interfere with the use of our facilities and network by other customers or authorized individuals;
  5. Publishing or transmitting any content of links that incite violence, depict a violent act, depict child pornography, or threaten anyone’s health and safety;
  6. Any act or omission in violation of consumer protection laws and regulations;
  7. Any violation of a person’s privacy.

Our Products may not be used by any person or entity, which is involved with or suspected of involvement in activities or causes relating to illegal gambling; terrorism; narcotics trafficking; arms trafficking or the proliferation, development, design, manufacture, production, stockpiling, or use of nuclear, chemical or biological weapons, weapons of mass destruction, or missiles; in each case including any affiliation with others whatsoever who support the above such activities or causes.

We prohibit the impersonation of www.paultoursafari.com, the representation of a significant business relationship with www.paultoursafari.com, or ownership of any www.paultoursafari.com property (including our Products and brand) for the purpose of fraudulently gaining service, custom, patronage, or user trust.

About this policy

This policy outlines a non-exclusive list of activities and intent we deem unacceptable and incompatible with our brand.

We reserve the right to modify this policy at any time by publishing the revised version on our website. The revised version will be effective from the earlier of:

  • the date the customer uses our Products after we publish the revised version on our website; or
  • 30 days after we publish the revised version on our website.

This Business Travel Agreement (“Agreement”) is a legal agreement between: 

(1) Paul Tours And  Safari  Limited  incorporated under the laws of the United of Republic of Tanzania, and  having its registered address at  Dar es salaam, the Tanzania (“Paul Tours Safari“, “us“, “we” or “our“); and  

(2) the organization or person which has registered for the Service on our Platform (“Business Customer”, “you”, “your”),  

each a “Party” and together the “Parties“. 

This Agreement sets out the terms and conditions that apply to your use of our Service.  

You can apply to become a Business Customer by completing the online business customer registration  procedure on our Platform. By completing all necessary fields of the online form and clicking the ‘Submit’ button, you are making an offer to become a Business Customer. However, you will only become a Business  Customer when Paul Tours Safari confirms your registration at which point this Agreement shall come into  existence. This Agreement will then continue until it is terminated in accordance with clause 3. 

Please note that we do not provide the Service exclusively to you and may provide the same or similar  services to any other person. 

  1. Definitions 

1.1 “Effective Date” means the date upon which Paul Tours Safari confirms your application to become a  Paul Tours Safari business customer. 

1.2 “Platform” means the website and app (including mobile) on which the Service is made available  by Paul Tours Safari and which is owned, controlled, managed, maintained and/or hosted in  accordance with the Terms of Use. 

1.3 “Reservation” has the meaning given to it in clause 2.2. 

1.4 “Service” means the online reservation service (including the facilitation of payments) for business  customers of various products and services for business travel as from time to time made available  by Suppliers on the Platform. 

1.5 “Supplier” means the provider of a Travel Arrangement. 

1.6 “Travel Arrangements” means accommodation (e.g. hotel, motel, Lodges, apartment, bed & breakfast),  transport (e.g. flights, rail and coach travel and transfers) tour operators, insurances, and any other  travel or related product or service as from time to time available for reservation by business  customers on the Platform. 

  1. This Business Travel Agreement 

2.1 Through the Platform, we (Paul Tours Safari and its affiliate (distribution) partners) provide an  online platform through which:  

(a) Suppliers can advertise Travel Arrangements for reservation; and  

(b) Business customers can make reservations for such Travel Arrangements for business  purposes.

2.2 As a Business Customer, you may submit requests to book Travel Arrangements for business  purposes through our Platform. Each such reservation request that you make, and each  reservation that is confirmed by us on the Supplier’s behalf (a “Reservation“), is made on and  subject to the terms and conditions of this Agreement.  

2.3 The Service that we provide to you in respect of each Reservation shall form part of this Agreement  and shall not form a separate contract to it. 

2.4 Paul Tours Safari may from time to time update and adjust this Agreement, subject to prior  communication (e.g. email or system notice) to the Business Customer with due observance of a  notice period of 15 days. Any updated or adjusted version shall replace and supersede the existing  (current) version. 

  1. Term and termination 

3.1 This Agreement shall commence on the Effective Date and shall continue until terminated in  accordance with the terms of this clause 3. 

3.2 Either Party may terminate this Agreement upon giving 7 days’ written notice to the other Party.  3.3 Either Party may terminate this Agreement immediately upon written notice to the other Party if: 

(a) the other Party has committed a material breach of its obligations under this Agreement  and has failed to cure such material breach within fourteen (14) calendar days of receipt  by the other Party of written notice thereof;  

(b) the other Party suspends or ceases trading or indicates that it intends to cease trading or becomes unable to pay its debts as they fall due; or 

(c) the other Party has a receiver, liquidator or administrator appointed, or passes an effective  resolution for its winding up (except for the purpose of amalgamation, reconstruction or  reorganization) or a Court makes an order to that effect or a similar event occurs. 

3.4 Termination of this Agreement in accordance with clauses 3.2 and 3.3 shall not affect any  confirmed but unfulfilled Reservations which exist at the date of termination, which shall continue  to be governed by the terms of this Agreement. 

  1. Scope of our Service 

4.1 Paul Tour Safari does not own, control or operate the Travel Arrangements or the Suppliers such as hotel, flights, cruise. But Paul Tours Safari has its own control and operates  tours and safari packages only.   

4.2 By making a reservation through the Platform, you enter into a direct (legally binding) contractual  relationship with the Supplier(s) of the Travel Arrangement(s). From the point at which you make  your Reservation, we act solely as an intermediary between you and the Supplier, transmitting the  details of your Reservation to the relevant Supplier(s) and sending you a confirmation email for  and on behalf of the Supplier. 

4.3 When rendering our Service, the information that we disclose is based on the information provided  to us by Suppliers. As such, the Suppliers are given access to an extranet through which they are  fully responsible for updating all rates, availability and other information which is displayed on our  Platform. Although we will use reasonable skill and care in performing our Service, we will not verify  if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held  responsible for any errors (including manifest and typographical errors), any interruptions (whether  due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Platform  or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each

Supplier remains responsible at all times for the accuracy, completeness and correctness of the  (descriptive) information (including the rates and availability) displayed on our Platform. Our  Platform does not constitute and should not be regarded as a recommendation or endorsement of  the quality, service level, qualification or (star) rating of any Supplier (or its facilities, venue,  products or services) made available. 

4.4 Our Service is made available solely for the Business Customer to arrange business travel for its  own use. Therefore, you are not allowed to resell, deep-link, use, copy, monitor (e.g. spider,  scrape), display, download or reproduce any content or information, software, reservations, tickets,  products or services available on our Platform for any commercial or competitive activity or  purpose. 

  1. Prices, crossed-out rates and Best Price Guarantee  

5.1 The prices on our Platform are highly competitive. All room prices are per room for your entire stay  and all prices are displayed including VAT/sales tax and all other taxes (subject to change of such  taxes), unless stated differently on our Platform or the confirmation email/ticket. Ticket prices are  per person or group and subject to validity as indicated on the ticket, if applicable. Applicable fees  and taxes (including tourist/city tax) may be charged by the Supplier in the event of a no-show or  cancellation fee. Tours and Safari packages prices are per person Including VAT/sales tax and all other Applicable taxes may be charged by the Supplier in the event of a no-show or  cancellation fee. 

5.2 Sometimes cheaper rates are available on our Platform for a specific stay, product or service,  however, these rates made available by Suppliers may carry special restrictions and conditions,  for example non-cancellable and non-refundable. Please check the relevant product, service and  reservation conditions and details thoroughly for any such conditions prior to making your  reservation. 

5.3 The crossed-out rate shown for rooms is based on the third highest current price of the Supplier  for your product or service with the same booking conditions in a 30-day window around your  check-in date (15 days before and 15 days after check-in date; if less than 15 days are between  today and the check-in date, we will use the corresponding number of days after the check-in date  to result in a 30-day total). To ensure we are making a fair comparison, we always use the same  reservation conditions (e.g. meal plan, cancellation policy and room type). This means that you get  the same room for a lower price compared to other check-in dates at the same time of year. 

5.4 We want you to pay the lowest price possible for your product and service of choice. Should you  find your product or service of choice booked through the Platform, with the same reservation  conditions, at a lower rate on the Internet after you have made a Reservation through us, we will  match the difference between our rate and the lower rate under the terms and conditions of the  Best Price Guarantee. 

5.5 The currency converter is for information purposes only and should not be relied upon as accurate  and real time; actual rates may vary. 

5.6 Obvious errors and mistakes (including misprints) are not binding. 

5.7 All special offers and promotions are marked as such. 

  1. Privacy and personal data protection 

6.1 Parties shall use commercially reasonable efforts to safeguard the confidentiality and privacy of  any personal data processed in the context of this Agreement and to protect it from unauthorized  use or release. Save as otherwise provided in this Agreement, each Party agrees to comply with  the applicable (data and Privacy) laws, rules and regulations of the jurisdiction where such Party

is incorporated (including (if applicable) the General Data Protection Regulation 2016/679 (the  “GDPR”) and the EU member state law implementing the GDPR and the Directive on privacy and  electronic communications (2002/58/EC), as amended or replaced. 

6.2 Each Party shall process personal data under this Agreement as a data controller within the  meaning of the GDPR and shall be responsible for its own compliance under applicable data  protection law for such processing activities. 

6.3 Business Customer understands and agrees that Paul Tour Safari shall process any personal data  collected and relating to Business Customer and/or any persons acting on its behalf in accordance  with the Paul Tour Safari privacy statement for business partners, and the Paul Tour Safari  privacy  statement.  

  1. Free of charge 

7.1 Our service is free of charge because, unlike many other parties, we will not charge you for our  Service or add any additional (reservation) fees to the rate. 

7.2 Suppliers pay a commission (being a small percentage of the product price (e.g. room price)) to  Paul Tour Safari after the Travel Arrangement is complete. 

  1. Credit card or bank transfer 

8.1 If applicable and available, certain Suppliers offer the opportunity for Reservations to be paid  (wholly or partly and as required under the payment policy of the Supplier) to the Supplier during  the reservation process by means of secure online payment (all to the extent offered and supported  by your bank). For certain products and services, Paul Tour Safari facilitates (through third party  payment processors) the payment of the relevant Travel Arrangement (i.e. the payment facilitation  service) for and on behalf of the Supplier (Paul Tours Safari never acts nor operates as the merchant  of record). Payment is safely processed from your credit/debit card or bank account to the bank  account of the Supplier through a third party payment processor. Any payment facilitated by us for  and on behalf of, and transferred to the Supplier will in each case constitute a payment of (all or  part of) the booking price by you of the Travel Arrangement in final settlement (bevrijdende  betaling) of such (full or partial) due and payable price and you cannot reclaim such paid monies. 

8.2 For certain (non-refundable) rates or special offers, please note that Suppliers may require that  payment is made upfront by wire transfer (if available) or by credit card, and therefore your credit  card may be pre-authorised or charged (sometimes without any option for refund) upon making the  Reservation. Please check the (Reservation) details of your Travel Arrangement thoroughly for any  such conditions prior to making your Reservation. You will not hold Paul Tour Safari liable or  responsible for any (authorized, (allegedly) unauthorized or wrong) charge by the Supplier and not  (re)claim any amount for any valid or authorized charge by the Supplier (including for pre-paid  rates, no-show and chargeable cancellation) of your credit card. 

8.3 In the event of credit card fraud or unauthorized use of your credit card by third parties, most banks  and credit card companies bear the risk and cover all the charges resulting from such fraud or  misuse, which may sometimes be subject to a deductible (usually set at USD 40 (or the equivalent  in your local currency)). In the event that your credit card company or bank charges the deductible  from you because of unauthorized transactions resulting from a reservation made on our Platform,  we will pay you this deductible, up to an aggregate amount of USD 40 (or the equivalent in your  local currency). In order to indemnify you, please make sure that you report this fraud to your credit  card provider (in accordance with its reporting rules and procedures) and contact us immediately  by email (support@paultoursafari.com). Please state ‘credit card fraud’ in the subject line of  your email and provide us with evidence of the charged deductible (e.g. policy of the credit card  company). This indemnification only applies to credit card reservations made using Paul Tour Safari

secure server and the unauthorized use of your credit card resulted through our default or  negligence and through no fault of your own while using the secure server. 

  1. Pre – payment, cancellation, no-show and fine print 

9.1 By making a Reservation with a Supplier, you accept and agree to the relevant cancellation and  no-show policy of that Supplier, and to any additional (delivery or other) terms and conditions of  the Supplier that may apply to your trip, visit or stay (including the fine print of the Supplier made  available on our Platform and the relevant house rules of the Supplier), including for services  rendered and/or products offered by the Supplier (the delivery terms and conditions of a Supplier 

can be obtained with the relevant Supplier). The general cancellation and no-show policy of each  Supplier is made available on our Platform on the Supplier information pages, during the  reservation procedure and in the confirmation email or ticket (if applicable). Please note that certain  rates or special offers are not eligible for cancellation or change. Applicable city/tourist tax may still  be charged by the Supplier in the event of a no-show or charged cancellation. Please check the  (Reservation) details of your Travel Arrangement thoroughly for any such conditions prior to making  your Reservation. Please note that a Reservation which requires down payment or (wholly or  partly) prepayment may be canceled (without a prior notice of default or warning) insofar the  relevant (remaining) amount(s) cannot be collected in full on the relevant payment date in  accordance with the relevant payment policy of the Supplier and the Reservation. Cancellation and  prepayment policies may vary according to room or booking type. Please carefully read the fine  print (below the room types or at the bottom of each Supplier page on our Platform) and important  information in your Reservation confirmation for additional policies as may be applied by the  Supplier (e.g. in respect of age requirement, security deposit, non-cancellation/additional  supplements for group bookings, extra beds/no free breakfast, pets/cards accepted). Late  payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are  for your own risk and account and you shall not be entitled to any refund of any (non-refundable)  prepaid amount unless the Supplier agrees or allows otherwise under its (pre)payment and  cancellation policy. 

9.2 If you wish to review, adjust or cancel your Reservation, please revert to the confirmation email  and follow the instructions therein. Please note that you may be charged for your cancellation in  accordance with the Supplier’s cancellation, (pre)payment and no-show policy or not be entitled to  any repayment of any (pre)paid amount. We recommend that you read the cancellation,  (pre)payment and no-show policy of the Supplier carefully prior to making your Reservation and  remember to make further payments on time as may be required for the relevant Reservation. 

9.3 If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to  (timely/promptly) communicate this with the Supplier so they know when to expect you to avoid  cancellation of your Reservation or room or charge of the no-show fee. Our customer service  department can help you if needed with informing the Supplier. Paul Tours Safari does not accept any  liability or responsibility for the consequences of your delayed arrival or any cancellation or charged  no-show fee by the Supplier. 

  1. (Further) correspondence and communication 

10.1 By completing a Reservation, you agree to receive (i) an email which we may send you shortly  prior to your arrival or commencement date, giving you information on your destination and  providing you with certain information and offers (including third party offers to the extent that you  have actively opted in for this information) relevant to your Reservation and destination, and (ii) an  email which we may send to you promptly after your stay inviting you to complete our review form.  Please see our privacy and cookies policy for more information about how we may contact you. 

10.2 Paul Tours Safari disclaims any liability or responsibility for any communication with the Supplier on or  through its Platform. You cannot derive any rights from any request to, or communication with the

Supplier or (any form of) acknowledgement of receipt of any communication or request.  Paul Tours Safari cannot guarantee that any request or communication will be (duly and timely)  received/read by, complied with, executed or accepted by the Supplier. 

10.3 In order to duly complete and secure your Reservation, you need to use your correct email address.  We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled  email address or inaccurate or wrong (mobile) phone number or credit card number. 

10.4 Any claim or complaint against Paul Tours Safari or in respect of the Service must be promptly  submitted, but in any event within 30 days after the scheduled end date of the Travel Arrangement (e.g. check out date or arrival at destination date in respect of flight bookings). Any claim or  complaint that is submitted after the 30 days period, may be rejected and the claimant shall forfeit  its right to any (damage or cost) compensation. 

10.5 Due to the continuous update and adjustments of rates and availability, we strongly suggest that  you make screenshots when making a Reservation to support your position (if needed). 

  1. Ranking, preferred programme, stars and guest reviews 

11.1 The default setting of the ranking of Suppliers on our Platform is ‘Recommended’ (or any similar  wording) (the “Default Ranking”). For your convenience we also offer other ways to rank Supplier.  Please note that the Default Ranking is created through a fully automatic ranking system  (algorithm) and based on multiple criteria, which include not only the popularity of a Supplier among  our visitors, but also customer service history and certain booking-related data (number of  bookings, cancellations, conversion rate, etc). On-time payment of commission by a Supplier and  the commission percentage are also included in the algorithm; however, they are two of the several  (but definitely not leading) factors in the Default Ranking. 

11.2 In certain cities and regions, Paul tours safari operates a preferred partnership program, allowing  certain Suppliers that meet and maintain the preferred program terms to be listed ahead of the rest  of the Suppliers in the default “Recommended” ranking for the relevant city/region. The preferred  Suppliers are marked with a “thumbs-up” symbol and in return for this high ranking, the preferred  Supplier pays a higher commission. Only Suppliers that meet and maintain certain qualification  criteria can be listed as preferred. 

11.3 The stars used for non-hotel accommodations (e.g. bed & breakfasts) do not correspond to the  star ranking system as may be applicable to hotel accommodations. 

11.4 A completed review may be (a) uploaded onto the relevant Supplier’s information page on our  Platform for the sole purpose of informing (future) customers of your opinion of the service (level)  and quality of the Supplier, and (b) (wholly or partly) used and placed by Paul Tours Safari at its sole  discretion (e.g. for marketing, promotion or improvement of our service) on our Platform or such  social media platforms, newsletters, special promotions, apps or other channels owned, hosted,  used or controlled by Paul Tours Safari and our business partners. We reserve the right to adjust,  refuse or remove reviews at our sole discretion. The review form should be regarded as a survey  and does not include any (further commercial) offers, invitations or incentives whatsoever. 

  1. Disclaimer 

12.1 Subject to the limitations set out in this Agreement and to the extent permitted by law, we shall only  be liable for direct damages actually suffered, paid or incurred by you due to an attributable  shortcoming of our obligations in respect to our Service, up to an aggregate amount of the  aggregate cost of your Reservations confirmed and paid for during the 12 months prior to your  claim arising as set out in your confirmation emails (whether for one event or a series of connected  events).

12.2 However and to the extent permitted by law, neither we nor any of our officers, directors,  employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution)  partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise  making available the Platform and its contents shall be liable for (i) any punitive, special, indirect  or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of  contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to  the (descriptive) information (including rates, availability and ratings) of the Supplier as made  available on our Platform, (iii) the services rendered or the products offered by the Supplier or other  business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs  suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability  to use or delay of our Platform, or (v) any (personal) injury, death, property damage, or other (direct,  indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by  you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct,  omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly)  attributable to the Supplier or any of our other business partners (including any of their employees,  directors, officers, agents, representatives or affiliated companies) whose products or service are  (directly or indirectly) made available, offered or promoted on or through the Platform, including  any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control. 

12.3 Whether or not the Supplier has charged you for your Travel Arrangement, or if we are facilitating  the payment of the price, you agree and acknowledge that the Supplier is at all times responsible  for the collection, withholding, remittance and payment of the applicable taxes due on the total  amount of the price to the relevant tax authorities. Paul Tours Safari is not liable or responsible for the  remittance, collection, withholding or payment of the relevant taxes due on the price to the relevant  tax authorities. Paul Tours Safari does not act as the merchant of record for any product or service  made available on the Platform. 

12.4 By uploading photos/images onto our system (for instance in addition to a review) you certify,  warrant and agree that you own the copyright to the photos/images and that you agree that  Paul Tours Safari may use the uploaded photos/images on its (mobile) website and app, and in  (online/offline) promotional materials and publications and as Paul Tours Safari at its discretion sees  fit. You are granting Paul Tours Safari a non-exclusive, worldwide, irrevocable, unconditional, perpetual  right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate  and make available the photos/images as Paul Tour Safari at its discretion sees fit. By uploading these  photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any  and all legal claims that are made by any third parties (including, but not limited to, accommodation  owners) due to Paul Tours Safari publishing and using these photos/images. Paul Tour Safari does not  own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of  all photos/images is assumed by the person who uploaded the photo, and is not the responsibility  of Paul Tour Safari disclaims all responsibility and liability for the pictures posted. The  person who uploaded the photo warrants that the photos/images shall not contain any viruses,  Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting,  objectionable or inappropriate material and does not infringe any third party (intellectual property  right, copyright or privacy) rights. Any photo/image that does not meet the aforesaid criteria will not  be posted and/or can be removed/deleted by Paul Tours Safari at any time and without prior notice. 

  1. Intellectual property rights 

13.1 Unless stated otherwise, the software required for our Service or available at or used by our  Platform and the intellectual property rights (including the copyrights) of the contents and  information of and material on our Platform are owned by Paul Tours Safari  Limited, its suppliers or  providers. 

13.2 Paul Tours Safari  exclusively retains ownership of all rights, title and interest in and to (all intellectual  property rights of) (the look and feel (including infrastructure) of) the Platform on which the service

is made available (including the guest reviews and translated content) and you are not entitled to  copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or  otherwise use the content (including any translations thereof and the guest reviews) or our brand  without our express written permission. To the extent that you would (wholly or partly) use or  combine our (translated) content (including guest reviews) or would otherwise own any intellectual  property rights in the Platform or any (translated) content or guest reviews, you hereby assign,  transfer and set over all such intellectual property rights to Paul Tours Safari. Any unlawful use or any  of the aforementioned actions or behavior will constitute a material infringement of our intellectual  property rights (including copyright and database right). 

  1. Travel Regulations 

14.1 Paul Tours Safari and the Business Customer agree that this Agreement is a “General Agreement“,  as this term is defined in Article 2(2)(c) of the EU Package Travel Directive 2015/2302 (as  transposed by each Member State and as may be amended from time to time) and Regulation  10(3) of The Civil Aviation (Air Travel Organizers’ Licensing Regulations 2012 (collectively, the  “Travel Regulations“). As such, the Parties agree that the Travel Regulations shall not apply to  any Reservations made under the terms of this Agreement. 

  1. Miscellaneous 

15.1 To the extent permitted by law, this Agreement and the provision of our Service shall be governed  by and construed in accordance with Tanzania law and any dispute arising out of this Agreement and  our Service shall exclusively be submitted to the competent courts in the United Republic of Tanzania.

15.2 The original English version of this Agreement may have been translated into other languages.  The translated version is a courtesy and office translation only and you cannot derive any rights  from the translated version. In the event of a dispute about the contents or interpretation of this  Agreement or inconsistency or discrepancy between the English version and any other language  version of this Agreement, the English language version to the extent permitted by law shall apply,  prevail and be conclusive. The English version is available on our Platform (by selecting the English  language) or shall be sent to you upon your written request. 

15.3 If any provision of this Agreement is or becomes invalid, unenforceable or non-binding, you shall  remain bound by all other provisions hereof. In such an event, such invalid provision shall nonetheless  be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept  a similar effect as the invalid, unenforceable or non-binding provision, given the contents and  purpose of this Agreement. 

  1. About Paul Tour Safari and the support companies 

16.1 The Travel Company service is rendered by Paul Tours And Safari , which is a private limited   company, incorporated under the laws of the United Republic of Tanzania and having its offices at Dar es salaam  and registered with the trade register of the Chamber  of Commerce in Tanzania under registration number 170969804. 

16.2 Paul Tours Safari has its headquarters in Dar es salaam the United Republic of Tanzania. 

 

                

For standard tours (private and small group), cancellations made at least 15 days prior to the tour date are eligible for a 100% refund or future travel credit (less ticket and reservation fees). Cancellations made between 14 days and 48 hours prior to the tour date are eligible for a 50% refund or future travel credit. All sales are final within 48 hours of the tour date. Venue tickets and reservation fees are non refundable and non transferable. (In the event that you request a tour reschedule, Paul Tour Safari will need to purchase and charge for new tickets / reservation fees.)

For custom tours, cancellations made at least 15 days prior to the tour date are eligible for a 50% refund or future travel credit. All sales are final within 14 days of the tour date. Ticket or reservation fees will be deducted from the refund. See the full cancellation policy below for tours in Tanzania, as the above terms do not apply. 

 

For Paul Tours Safari, cancellations made at least 90 days prior to the start date are eligible for a refund less the initial deposit. All sales are final within 90 days of the start date.

 

Cancellation Policy

 

A note due to the pandemic: to promote and uphold the safety of our guests, guides, and their local communities, Context has developed a COVID safety policy that can be viewed. All guides and guests are obligated to uphold this policy and, by booking with Paul Tours Safari, you are agreeing to do so. 

Paul Tour Safari strongly recommends purchasing travel insurance to mitigate potentially non-refundable costs.

 Please review the following terms of service (the “Terms of Service”), which will govern your registration with and use of the Paul Tours Safari website www.paultoursafari.com (the “Site”), including all content and services provided by Paul Tours Safari,” “us,” “we” or “our”) on or in conjunction with the Site including, but not limited to, booking, private and semi-private group tours, custom tours collaboration and other goods and services (the “Services”), and accepting certain exclusions as noted below.

By accessing or using the Site you agree to be bound by these Terms of Service as well as the terms of the Privacy Policy, which is available on the Site.

We reserve the right, in our sole discretion, to change or modify portions of these Terms of Service at any time. If we do so, we will post the changes on this page and will indicate at the top of this page the date the revised Terms of Service were effective. You may read the then-current copy of these Terms of Service at any time by selecting the “Terms of Service” link on the Site. We may also notify you of material changes from time to time through a pop-up notice, e-mail or other reasonable means, but we shall not be obligated to do so. Your continued use of the Site after any change by us constitutes your acceptance of the new Terms of Service.   1. Site Access and Registration.

We hereby grant you permission to use the Site as set forth in these Terms of Service provided that: (i) your use of the Site is solely for your personal use; (ii) you will not copy or distribute any part of the Site in any medium without Paul Tours Safari prior written authorization; (iii) you will not alter or modify any part of the Site other than as may be reasonably necessary to use the Site for its intended purpose; and (iv) you will otherwise comply with these Terms of Service.

You agree not to: (a) take any action that imposes an unreasonable load on the Site’s infrastructure; (b) use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any activity being conducted on the Site; (c) attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or making up of the Site; (d) delete or alter any material we or any other person or entity posts on the Site; or (e) otherwise take any action in violation of our guidelines and policies.

 

  1. You may register for an account on the Site (an “Account”). To use certain portions of the Site, you are not required to sign up for an Account. However, there are features of the Site, such as accessing your order history, that require you to register for an Account. You must provide accurate and complete information and keep your Account information updated. You may not: (i) select or use as a username a name of another person with the intent to impersonate that person; 

(ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or 

(iii) use as a username a name that is otherwise offensive, vulgar or obscene. 

 

  1. You are solely responsible for the activity that occurs on your Account, and for keeping your Account password secure. You may never use another person’s Account or registration information for the Site without that person’s permission. You must notify us immediately of any change in your eligibility to use the Site, breach of security or unauthorized use of your Account. You should never publish, distribute or post login information for your Account. You have the ability to shut down your Account at any time. Notwithstanding the above or anything to the contrary set forth in these Terms of Service, Paul Tours Safari shall have the absolute and unlimited right to: (i) reject any potential Account; and (ii) terminate any Account in its sole discretion and without reason.

 

  1. Booking and Payment. 

 

  1. By booking a reservation for the Services through the Site, you acknowledge that you accept these Terms of Service and our Privacy Policy. In addition, you warrant that you are 18 years of age or older, that you possess the legal authority to enter into these Terms of Service, use this Site and, book the Services or purchase goods, and that all information you supply is and will be true and accurate. You further agree that you will use the booking functionality of this Site to make only legitimate reservations for you or others for whom you are legally authorized to act. Any false or fraudulent reservation is prohibited, and any user who attempts such a reservation may have his or her Account terminated.
  2. You agree to provide accurate and up-to-date payment information at the time you make a reservation. We have contracted with a third-party payment processor to facilitate purchases made on the Site. When you make a reservation through the Site, you will provide your payment details and any additional information required to complete your order to us. We will then send your information to our third-party processor to complete your transaction. .  For your convenience, we do retain the following information for each credit card used on the Site: 1) card type; 2) the last four digits of the card; and 3) the name of the card.  We may retain this information indefinitely unless and until you request that we remove this information from our network. We do not retain any of your payment information.  You should be aware that online payment transactions are subject to validation checks by our payment processor and your card issuer, and we are not responsible if your card issuer declined to authorize payment for any reason. For your protection, our payment processor uses various fraud prevention protocols and industry standard verification systems to reduce fraud. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this. In some jurisdictions, our payment processor may use third parties under strict confidentiality and data protection requirements for the purposes of payment processing services.
  3. You agree to have sufficient funds or credit available upon placement of any such reservation to ensure that the purchase price will be collectible by us. After you place your reservation, we will send you a confirmation email. We strive to provide accurate pricing information regarding the Services available on the Site. However, mistakes happen and we cannot guarantee there will never be pricing errors. We reserve the right, at our sole discretion, to not process or to cancel any reservations placed for the Services in which the price was incorrectly posted on the Site as a result of an error. If this occurs, we will notify you by email. 
  4. The Site may contain information regarding the availability of the Services. In some cases, the Services may be available when you make your reservation, and completely booked by the time we attempt to process the reservation. Should this happen, we will notify you by email and cancel the Services from your reservation.
  5. The Context Journeys products shown on the Site adhere to different payment and booking terms than do private, semi-private, and custom tour products. Please see Paul Tours Safari terms and conditions for detail.

 

  1. Changes and Cancellation by You.
  2. The information in this subparagraph 3(a) applies to all Paul Tours Safari private, semi-private group, custom Journeys, and Tanzania/ Zanzibar tours as outlined in subparagraphs (b), (c), (d), (e), and (f). All tickets for transportation and third-party venues are non-refundable for semi-private, private, and custom tours. Refunds can take up to 60 days from the date of cancellation to be processed and will be issued to your original method of payment. All tours run rain or shine though there may be variations to accommodate the weather. All tours will start promptly on time. If you arrive 10 minutes or more after the reservation time for a semi-private tour, your reservation will be canceled and no refund will be issued. If you arrive 45 minutes or more after the reservation time for a private or a custom tour, your reservation will be canceled and no refund will be issued. No-shows for all tours, including Zanzibar and Tanzania and Paul Tour Safari, are treated as last-minute cancellations and no refund will be issued.
  3. Private and semi-private (“small group”) tours – You may cancel reservations for small group and private tours up to fifteen (15) days prior to the service date and receive a 100% refund or future travel credit . Within fifteen (15) days, you may cancel up to forty-eight (48) hours in advance of the reservation start date and time for a 50% refund or future travel credit; we will retain the 50% balance as a processing and handling fee. Within 48 hours of the reservation start date and time, all sales are final and fully nonrefundable for private and semi-private tours. Please note the cancellation terms for specific  tours, as outlined below in subparagraphs (c), (d), and (e), and for cancellations due to unforeseeable events as outlined in subparagraph (f).
  4. Custom tours – You may cancel reservations for custom tours up to fifteen (15) days in advance of the reservation start date and time for a 50% refund or future travel credit; we will retain the 50% balance as a processing and handling fee. Within fifteen (15) days of the reservation start date and time, all sales are final and fully nonrefundable for custom tours. Please note the terms for cancellations due to unforeseeable events as outlined in subparagraph (f). 
  5. Paul Tour Safari – You may cancel reservations for Paul Tour Safari up to ninety (90) days prior to the Journey start date. Paul Tour Safari payments (including initial deposit) are non-refundable. Please see Paul Tour Safari terms and conditions for detail. 
  6. Exclusive Access Tours: you may cancel your reservation for After Hours for a full refund up to 60 days prior to the tour date.  After that date, cancellations made between 60 days and 48 hours prior to the tour date are eligible for a 50% refund or future travel credit.  All sales are final within 48 hours of the tour date. 
  7. Zanzibar and Tanzania – For reservations for tours in Zanzibar and Tanzania, the following cancellation terms apply and supersede the terms outlined in points (b) and (c) above.

 (i) For cancellations made up to ninety (92) days prior to the service start date, you will receive a 100% refund (or future travel credit) less a $700 non-refundable deposit. 

(ii) For cancellations made between 92 and 62 days prior to the service start date, you will receive a 70% refund (or future travel credit) of the total reservation fee. 

(iii) For cancellations made between 61 and 32 days prior to the service start date, you will receive a 40% refund (or future travel credit) of the total reservation fee.

 (iv) For cancellations made between 31 and 9 days prior to the service start date, you will receive a 15% refund (or future travel credit) of the total reservation fee. 

(v) All sales are final and fully nonrefundable for itineraries within eight (8) days of the reservation starting date and time.

  1. “Unforeseeable events” – If you are canceling a reservation for a semi-private, private, or custom tour due to “unforeseeable events” out of your control up to (more than) forty-eight (48) hours of the date and time of service, you will receive full (100%) credit to your Paul Tour Safari account, less irrecoverable ticket or reservation fees. Within forty-eight (48) hours of the date and time of service, all sales are final and fully non-refundable. The following and only the following constitute “unforeseeable events” if they occur after your booking is made:
  1. A Level 4: Do Not Travel advisory is issued by the TZ Department of State for the destination in which your services are booked;
  2. The travel corridor is shut between your starting point and destination of service, including border closures;
  3. Your cruise ship is unable to dock.
  1. Should you wish to make any changes to your reservation for a semi-private or private tour, you must request said changes as soon as possible and no later than seven (7) days before the date and time of your reservation. Should you wish to make any changes to your reservation for a custom tour, you must request said changes as soon as possible and no later than fifteen (15) days before the date and time of your reservation. Any change is subject to availability and to an administrative fee of up to 25% of the price of the original reservation. While we will attempt to accommodate your change request, we cannot guarantee we will be able to do so. If we cannot, you will have the option to maintain the existing reservation or to cancel as set forth in subparagraphs 3(b), (c), (e), and (f) above.

 

  1. Changes and Cancellation by Paul Tours Safari.
  2. We will make every reasonable effort to provide the Services in accordance with the descriptions provided on our Site. Although it is unlikely that we will have to make any changes to your reservation or cancel confirmed reservations, we reserve the right to do so should it become necessary or advisable. If we cancel your reservation, we will provide you either a credit that you may use towards another Service or a full refund at our discretion. 
  3. Please note some of the Services require a minimum number of participants.  If the minimum number of bookings required for a particular Service has not been received, we may cancel the Service. We will notify you of cancellation for this reason no later than 2 weeks before the date of the reservation.
  4. Paul Tours Safari products will be confirmed as soon as we have 10 confirmed (deposit paid) participants. If we do not have this number of participants 90 days prior to the Journey start date, we will cancel the tour and refund your deposit. Please see Paul Tour Safari terms and conditions for detail.

 

  1. Medical Conditions, Disabilities and General Health. 
  2. If you make a reservation for a Service, we will assume that you have no medical conditions, disabilities, general health issues or food or allergy issues (“Medical Conditions”) that would prevent or hamper you from participating in the Services.  In the event that you do in fact have any Medical Conditions, we will attempt to accommodate said Medical Conditions when we can and it is reasonable to do so. However, we do not guarantee that we or the venue can or will make any such accommodations.  In the event that you cannot participate in the Services because of undisclosed Medical Conditions, we may, in our sole discretion, offer a substitute Service or cancel your reservation without refund. Please contact us or the appropriate venue if you are unsure about whether you are able to participate in a Service. 
  3. Under no circumstances should you travel or use the Services if your doctor has advised you against it, or would advise you against it if consulted. 

 

  1. Trip Participation and Your Conduct. 
  2. You agree to accept the authority and decisions of our employees, guides and agents while on any tour with us. If in the opinion of any such person(s) or any other person in a position of authority, your health, level of fitness or conduct at any time before or during a trip is endangering or appears likely to endanger your health or wellbeing or that of any third party (including any other client of Paul Tours Safari) or the safe, comfortable or happy progress of the tour, you may be excluded from all or part of the tour without refund or recompense.
  3. You accept responsibility for the proper conduct of yourself and any or all other members of your group. We reserve the right in our reasonable discretion to terminate your tour or that of any member of your group whose conduct we or our guides consider disruptive or detrimental to the enjoyment of other guests, or whose conduct may prejudice our reputation, all in our sole discretion. In such an event we shall have no further responsibility or liability to you. No refund or payment of any costs incurred by you will be made by us under these circumstances.

 

  1. The Site and Advertising Accuracy. All information contained on the Site and in our advertising materials has been provided in good faith, and is considered correct at the time of publication. However, occasional errors may occur, and information may subsequently change, and we are not responsible for such errors or omissions. You must therefore ensure you check all details of your chosen Service (including the price) at the time of booking.  It would also be a good idea to confirm as the date approaches, though you are not required to do so.

 

  1. Third Party Sites. The Site may contain links to third party websites, services or other resources on the internet (“External Sites”). These links are provided solely as a convenience to you and not as an endorsement by us of the content on such External Sites. The content of such External Sites is developed and provided by others. You should contact the site administrator for those External Sites if you have any concerns regarding such links or any content located on such External Sites. We are not responsible for the content of any linked External Sites and do not make any representations regarding the content or accuracy of any materials on such External Sites. You should take precautions when downloading files from all websites to protect your computer from viruses and other destructive programs. If you decide to access any External Sites, you do so at your own risk. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods or services available on or through any External Sites.

 

  1. Reviews, Comments, Communications and Other Content.
  2. You may post reviews, comments, photos, videos, and other content (“User Content”) to the Site, so long as you represent and warrant that the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. 
  3. If you do post content or submit material, you grant Context Travel a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Context Travel and its sublicensees the right to use the name that you submit in connection with such content, if we choose to do so at our discretion. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate these Terms of Service and will not cause injury to any person or entity; and that you will indemnify Paul Tour Safari for all claims resulting from content you supply. Paul Tour Safari has the right, but not the obligation, to monitor and edit or remove any content. Paul Tour Safari takes no responsibility and assumes no liability for any content posted by you or any third party.

 

  1. Intellectual Property Rights.
  2. All information and content available on the Site and its “look and feel,” except all User Content, including but not limited to trademarks, logos, service marks, text, graphics, logos, button icons, images, audio/video clips, data compilations and software, and the compilation and organization thereof (collectively, the “Content”) is the property of the Context Travel and is protected by United Republic of Tanzania and international laws, including laws governing copyrights and trademarks. The reproduction and use of any of these by you is prohibited unless specific permission is provided by Paul Tour Safari. Any unauthorized use may violate copyright laws, trademark laws, privacy and publicity laws, and/or communications regulations and statutes of the United Republic of Tanzania and foreign laws and international conventions.
  3. The trademarks, service marks, logos, and other indicia (collectively the “Trademarks”) which appear on the Site are registered and unregistered trademarks of Paul Tours Safari. Nothing contained on the Site should be construed as granting, by implication or otherwise, any right, license or title to any of the Trademarks without the advance written permission from us. All rights are expressly reserved and retained by Paul Tour Safari. Your misuse of any of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms of Service, is strictly prohibited. 
  4. All materials provided to you during or in connection with the Services is Paul Tours Safari copyrighted work and is protected by United Republic of Tanzania and international laws. Nothing contained on the Site should be construed as granting, by implication or otherwise, any right, license or title to any of the copyrighted work without the advance written permission from us. All rights are expressly reserved and retained by us. Your misuse of any of the copyrighted work provided to you, except as provided in these Terms of Service, is strictly prohibited. 

 

  1. Digital Millennium Copyright Act. If you are a copyright owner or an agent thereof and believe that any User Content or other content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing Paul Tour Safari DMCA agent with the following information in writing:
  2. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  3. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  4. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
  5. Information reasonably sufficient to permit the DMCA agent to contact you, such as an address, telephone number, and, if available, an email address;
  6. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  7. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  1. Photos and Videos.
  2. Context Travel reserves the right to use photographs/video taken during the Services or at any event sponsored by Paul Tours Safari without further consent or written permission of those included within the photograph/video. We may use the photograph/video in publications or other media material produced, used or contracted by us including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc. To ensure the privacy of individuals and children, individuals will not be identified using full names or personal identifying information without written approval from the photographed subject, parent or legal guardian.  If you do not wish to have your image recorded for distribution, please advise us at info@paultoursafari.com prior to your reservation.  By participating in the Services or events and failing to notify us prior to your reservation or event of your desire to not have your photograph/video used by Paul Tours Safari, you are agreeing to allow us to do so and to release, defend, hold harmless and indemnify Paul Tours Safari from any and all claims involving the use of your picture or likeness.
  3. You may not use any photographs or videos recorded during the Services for commercial purposes.
